Part I — Terms & Conditions

1. Seller information

This website (www.epistemevintage.com), operating under the trade name Episteme Vintage, is owned and managed by:

(Hereinafter referred to as "Episteme Vintage", "we", "our" or "us".)

2. Purpose

​

These Terms & Conditions ("Terms") govern the use of the website www.epistemevintage.com and the purchase of vintage watches and watch memorabilia ("Products") offered on it. By placing an order, you ("the Customer", "you") confirm that you have read, understood and accepted these Terms in full.

​

3. Customer eligibility

​

To place an order on this website you must be at least 18 years old and have the legal capacity to enter into binding contracts in your country of residence. By placing an order you confirm that both conditions apply.

​

4. Products

​

All Products listed on the website are vintage and pre-owned items. Each Product is unique. Photographs, descriptions and condition reports are provided on each Product page; we make every effort to describe each item accurately, but minor variations due to age, materials and lighting in photographs are inherent to vintage goods and do not constitute a defect.

Episteme Vintage authenticates every item before publication. We are an independent specialist dealer and are not affiliated with the brands whose products we sell.

5. Prices

​

All prices are displayed in Euros (EUR) and include Spanish value-added tax (IVA) where applicable. Shipping costs and any applicable customs duties or import taxes outside the European Union are not included in the displayed price and are the responsibility of the Customer.

Episteme Vintage reserves the right to modify prices at any time. The price applicable to a given order is the one displayed at the moment the order is confirmed.

​

6. Order process

​

The contract is formed in the following steps:

​

1. You select the Product(s) and add them to the cart.

2. You provide shipping and billing information at checkout.

3. You choose a payment method and confirm the order.

4. We send you an order confirmation by email containing the order details.

5. We dispatch the order and notify you with the tracking information.

​

The order confirmation email constitutes acceptance of the contract. Until that email is sent, no contract exists between you and Episteme Vintage.

​

7. Payment

​

We accept the following payment methods:

​

• PayPal

• Credit and debit cards (Visa, Mastercard, American Express) through our secure payment processor

• Bank transfer for orders over €5,000 (subject to prior arrangement by email)

Payment is taken at the time of order. We do not store payment-card details on our servers; all transactions are processed by PCI-compliant payment providers with end-to-end encryption.

8. Shipping and delivery

​

Orders are dispatched within one working day of payment confirmation, except where stated otherwise on the Product page or in the order confirmation. We ship worldwide using tracked, fully insured courier services.

​

Estimated delivery times by region:

​

• Spain (mainland): 1–3 working days

• European Union: 2–5 working days

• United Kingdom & Switzerland: 3–7 working days

• United States & Canada: 5–10 working days

• Rest of the world: 7–14 working days

​

Delivery times are indicative and may vary depending on customs clearance and courier load. Risk of loss or damage transfers to the Customer upon delivery.

​

For shipments outside the European Union, the Customer is responsible for any customs duties, import taxes, brokerage fees or other charges imposed by the destination country. Local customs authorities can provide exact figures.

​

9. Right of withdrawal (14-day returns)

​

In accordance with Article 102 of Real Decreto Legislativo 1/2007 (Spanish Consumer Protection Act) and EU Directive 2011/83/EU on Consumer Rights, the Customer has the right to withdraw from the contract within fourteen (14) calendar days of receiving the Product, without giving any reason.

​

To exercise this right the Customer must notify Episteme Vintage by email to epistemevintage@gmail.com within the 14-day window. The notification must include the order number and the Customer's intent to return the Product.

​

The Product must be returned in the same condition in which it was received, including all original packaging, documentation, accessories and protective materials. The cost of return shipping is borne by the Customer.

​

Once we receive the returned Product and confirm that it is in the agreed condition, we will refund the original purchase price (including original shipping cost) within fourteen (14) days of receipt, using the same payment method used for the original transaction. The Customer's bank may take additional time to credit the refund.

​

10. Damaged or incorrect items

​

If a Product arrives damaged or differs materially from its description, the Customer must notify Episteme Vintage by email within 48 hours of delivery, providing photographs of the package and the Product as received. We will open an insurance claim with the courier and arrange a full refund (including shipping cost) or, where possible, send a replacement.

11. Authenticity guarantee

​

Episteme Vintage authenticates every Product before sale. In the unlikely event that any item sold by Episteme Vintage is later proven to be inauthentic, the Customer is entitled to a full refund without time limit, including reimbursement of original shipping and return shipping costs, upon presentation of credible documentation supporting the claim.

12. Limitation of liability

​

Beyond the legal warranties applicable to consumer purchases, Episteme Vintage's total liability arising from any order shall not exceed the amount paid by the Customer for the Product in question. Episteme Vintage shall not be liable for any indirect, incidental, consequential, special or punitive damages.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

13. Intellectual property

​

All content on www.epistemevintage.com — including text, photographs, logos, design, layout and code — is the property of PEARSOCIETY17 SL or its licensors and is protected by Spanish and international copyright laws. The Customer may not reproduce, distribute, publicly display or create derivative works from this content without prior written authorisation, except for personal, non-commercial use related to their purchase.

Trademarks of brands whose products we sell remain the property of their respective owners. References to those brands on this website are made solely for identification of vintage items offered for resale.

​

14. Force majeure

​

Episteme Vintage shall not be liable for any failure or delay in performance arising from events beyond its reasonable control, including natural disasters, strikes, war, pandemic, governmental restrictions or carrier disruptions.

​

15. Modifications to these Terms

​

Episteme Vintage reserves the right to modify these Terms at any time. The version applicable to a given order is the version in force on the date the order is placed. The current version is always available on this page.

16. Applicable law and jurisdiction

​

These Terms are governed by Spanish law. Any dispute arising from the use of this website or the purchase of Products shall be subject to the courts and tribunals of the city of Barcelona, Spain, except where mandatory consumer-protection law grants the Customer the right to bring proceedings in the courts of their own country of residence.

The European Commission's Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) is available for consumers resident in the European Union to attempt out-of-court resolution of disputes arising from online purchases.

This Privacy Policy describes how we collect, use, store and protect your personal data in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and Spanish Organic Law 3/2018 on the Protection of Personal Data (LOPDGDD).

2. Data we collect

We collect and process the following categories of personal data:

• Identification and contact data: name, surname, postal address, email address, telephone number.

• Order data: items purchased, order history, invoicing details, tax ID (when provided for invoicing purposes).

• Payment data: card details and PayPal details are NOT collected, stored or processed by Episteme Vintage — they are handled directly by our payment processors. We only receive a confirmation of the transaction.

• Technical data: IP address, browser type, device type, language preference, pages visited on our website (collected automatically through cookies and analytics tools — see section 7).

• Communications: content of emails or messages you send us through the contact channels.

We do not knowingly collect data from children under 14 years of age.

3. Purposes of processing

We process your personal data for the following purposes:

After the applicable retention period, data is securely deleted or anonymised.

• Courier services (DHL, UPS, Correos, MRW or similar) — order shipping.

• Tax and accounting professionals — fulfilment of legal obligations.

Some of these providers may transfer data outside the European Economic Area (e.g., to the United States). In such cases, the transfer is protected by appropriate safeguards such as the European Commission's Standard Contractual Clauses or equivalent legal mechanisms recognised by GDPR.

If you believe your data-protection rights have not been respected, you are also entitled to file a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es) or the equivalent authority in your country of residence.

9. Security measures

We have implemented appropriate technical and organisational measures to protect your personal data against unauthorised access, alteration, loss or disclosure. These include encrypted transmission (HTTPS), restricted access to data, security updates and regular review of our processes.

No security measure is, however, completely infallible. In the event of a personal data breach affecting your rights and freedoms, we will notify you and the competent supervisory authority as required by GDPR.
